Terms and Conditions (T&C)
NoctiVisuals – Photography, Videography, Photo Editing & Video Editing
1. Scope
These Terms and Conditions (T&C) apply to all services provided by NoctiVisuals, including photography, videography, photo editing, video editing, and content creation.
By booking a photoshoot or any other service, the client agrees to these Terms and Conditions.
2. Formation of Contract
A contract is concluded once NoctiVisuals confirms the booking in writing (e.g. via email, Instagram, or WhatsApp) and the agreed deposit has been received.
3. Pricing
All prices are individually agreed upon and offered as fixed prices unless otherwise agreed in writing.
Additional services requested by the client after the initial agreement may incur additional charges.
4. Deposit and Payment
A 50% deposit of the agreed total price is required to secure and confirm the booking.
The booking is only considered confirmed once the deposit has been received.
The remaining 50% is due after the photoshoot has been completed and before the edited images or videos are delivered.
All image and video files remain the property of NoctiVisuals until full payment has been received.
5. Rescheduling and Cancellation
Appointments may be rescheduled upon mutual agreement.
If the client cancels the booking, the deposit is generally non-refundable unless otherwise agreed in writing.
If NoctiVisuals is unable to carry out the booking due to illness, accident, force majeure, or other unforeseen circumstances, the deposit will either be refunded in full or transferred to a new appointment at the client’s request.
6. Photoshoot Execution
The photographer is responsible for creative decisions regarding composition, perspective, lighting, and the final selection of images.
Clients are not entitled to receive all photographs taken during the session, including RAW files.
The client agrees to arrive on time for the scheduled appointment.
Late arrival may reduce the duration of the session if subsequent bookings are scheduled.
If the client is more than 30 minutes late without prior notice, NoctiVisuals reserves the right to treat the appointment as cancelled. In such cases, the deposit will be forfeited.
7. Editing and Delivery
All images and videos are professionally edited.
Final files are delivered digitally via a download link or an online gallery unless otherwise agreed.
The standard delivery time is approximately 7 to 14 days, unless otherwise agreed.
8. Copyright and Usage Rights
All copyrights remain the exclusive property of NoctiVisuals.
Upon full payment, the client receives a non-exclusive license to use the delivered content for the agreed purpose.
Commercial use, resale, distribution, or transfer of images or videos requires prior written permission from NoctiVisuals.
The client may not substantially alter the images or videos or apply filters or AI-generated edits that significantly change the artistic style of NoctiVisuals.
9. Commercial Use and Licensing
Usage rights for businesses, brands, agencies, and commercial clients are agreed individually in writing.
Licensing fees may vary depending on:

10. Portfolio and Self-Promotion
Unless otherwise agreed in writing before the photoshoot, NoctiVisuals reserves the right to use selected images and videos for its portfolio, website, and social media channels.
If the client objects to such use before the photoshoot, the content will not be published.
11. Travel Expenses
Unless otherwise agreed, photoshoots within the Principality of Liechtenstein are included in the agreed price.
For assignments outside Liechtenstein, additional travel expenses such as mileage, parking fees, toll charges, accommodation, or other necessary travel costs may be charged.
Any such costs will be communicated to the client before the booking is confirmed.
12. Liability
NoctiVisuals shall only be liable for damages caused intentionally or through gross negligence.
No liability is accepted for delays, cancellations, or failures resulting from adverse weather conditions, force majeure, or technical failures despite proper maintenance and reasonable care.
13. Data Protection
Personal data is processed solely for the purpose of providing the agreed services and in accordance with the applicable data protection laws.
14. Final Provisions
These Terms and Conditions are governed by the laws of the Principality of Liechtenstein.
Should any provision of these Terms and Conditions become invalid or unenforceable, the remaining provisions shall remain unaffected and continue in full force and effect.

All processing is carried out solely for the purpose of fulfilling the agreed service, professionally editing the content, and delivering the final results to the client.
6. Use of Images, Videos and Edited Content
NoctiVisuals reserves the right to use selected photographs, videos, and edited content for its own business presentation, including its website, social media channels, portfolio, marketing, promotional, and reference purposes.
This applies to both self-produced content and edited client-provided content unless otherwise agreed in writing or prohibited by applicable law.
If a client wishes to object to publication, they must notify NoctiVisuals in writing before the project begins.
7. Data Retention
Personal data will only be stored for as long as necessary to fulfill contractual obligations, comply with legal retention requirements, or protect legitimate business interests.
8. Website Hosting
This website is hosted by Merlin Sites.
When you visit this website, technically necessary information (such as your IP address, browser type, date, and time of access) may be processed automatically to ensure the secure and reliable operation of the website.
9. Instagram
This website may contain links to or embedded content from Instagram.
When using these features, the privacy policy of Meta Platforms Ireland Limited also applies.
10. Data Security
We implement appropriate technical and organizational measures to protect personal data against unauthorized access, misuse, loss, alteration, or disclosure.
